Each platform has their own protocol, or lack thereof, and it is a tricky road to navigate. This is a brief guide to understanding how each platform manages accounts of the deceased.

### **Facebook**

An account owner can assign a Legacy Contact to manage their account after death. The Legacy Contact can control the Facebook account or close a memorialised account. An account can be memorialised by a close family or friend by presenting proof of death like, death certificate or obituary. A Legacy Contact has the ability to manage tribute posts on your profile, which includes deciding who can post and who can see posts, deleting posts, and removing tags. In the case that a Legacy Contact is not assigned, in order to deactivate the account, you need to provide documentation to confirm you're an immediate family member or executor of the account holder. The fastest way for Facebook to process your request is to provide a scan or photo of the account holder’s death certificate or you can also provide one of the following as proof of authority: a power of attorney, birth certificate, last will and testament, or estate letter and one of the following as proof of the deceased: obituary or memorial card.

### **Instagram**

Instagram offers two options for the account of the deceased or incapacitated, memorialize the account or deactivate it.&nbsp;

To memorialize an account, you must submit a request and provide proof of death, such as a link to an obituary or news article, to memorialize an account. Instagram specifically details that they will prevent references to memorialized accounts from appearing on Instagram in ways that may be upsetting to the person's friends and family, and they also take measures to protect the privacy of the deceased person by securing the account. This includes preventing anyone from logging into the account. They will not provide login information to anyone.&nbsp;

To deactivate the account, verified immediate family members may submit a request and submit proof of death, like the deceased person's birth certificate, death certificate, or proof of authority under local law that you are the lawful representative of the deceased person, or his/her estate.

### **Twitter**

In the event of a death, Twitter will work with a person authorized to act on behalf of the estate, or with a verified immediate family member of the deceased to have an account deactivated. After submitting a request, Twitter will email the fiduciary with instructions for providing more details, including information about the deceased, a copy of your ID, and a copy of the deceased’s death certificate. This is a necessary step to prevent false and/or unauthorized reports.

In the event of an incapacitated user, Twitter will work with a person authorized to act on the behalf of the user to have an account deactivated. After submitting a request, Twitter will email the authorized individual with instructions for providing more details, including information about the user, a copy of your ID, a copy of the account holder’s ID, and a copy of a Power of Attorney authorizing you to act on the account holder’s behalf. This is a necessary step to prevent false and/or unauthorized reports.

### **YouTube**

It appears there is no specific route to handle a YouTube account, due to its affiliation and ownership by Google. The YouTube account is connected with the Google account itself and the actions you take on the account as a whole will affect the other affiliated accounts.&nbsp;

If you’d like to make plans for your account, Google offers an Inactive Account Manager. It is a means for users to share parts of their account data or notify someone if they’ve been inactive for a certain period of time. Google detects the last time your Google accounts and applications were used and in the event that the account has been inactive for a prolonged period of time, set by you, a notification will be sent to your trusted contact of choice. You must provide the phone number of your trusted contact as a means of verification so, only your appointed contact will be able to access your data. If you choose to only notify your contacts of your inactive account, they'll receive an email with a subject line and content that you composed during setup. Google will add a footer to that email, explaining that you've instructed Google to send an email on your behalf after you've stopped using your account. If you choose to share data with your trusted contact, the email will additionally contain a list of the data you have chosen to share with them and a link they can follow to download the data. Keep in mind that deleting your Google Account will affect all products associated with that account.&nbsp;

In the event the user did not set up an Inactive Account Notification, you must submit a request with Google that will be carefully reviewed before acted on, to protect the privacy of the user. Additionally, they will not provide any login information from the account.

### **LinkedIn**

If you have the authority to act on behalf of a deceased member, you can request to memorialize or close the account. If the account is closed, it can take up to 21 days to completely delete the data from LinkedIn’s system.

If you aren’t authorized to act on behalf of a deceased member, you can report them as deceased. Reporting a deceased member will result in the account being hidden. Once an account is hidden, the profile is no longer searchable or visible on LinkedIn.

In order to submit the request, you will need the following information:&nbsp;

* Member's full name
* LinkedIn profile link/URL
* Your relationship
* Member's email address
* Date of their passing
* Link to an obituary

For requests to memorialize or close the account, will still need a copy of the member’s death certificate and one of the following legal documents to show you have the authority to act on behalf of the deceased member:

* Letters of Administration
* Letters of Testamentary
* Letters of Representation
* Other court order appointing the requestor as an authorized representative for the deceased member’s estate

While the social media platform is still quite popular, without a plan for your executor to enact after your death, your Snapchat account will probably continue to exist for an unknown period of time before Snapchat will delete it. Snapchat is not forthcoming about what happens to the accounts of deceased users.

### **TikTok**

Despite being currently one of the most popular social media platforms, TikTok has no existing features for requesting permanent deletion by family members or representatives of their estate. Currently, only the original creator or someone with access to their login details can request permanent deletion or manage the account after a person has passed.

Many people do not loewe explicit instructions for what to do with their various digital accounts like social media, emails, gaming accounts, and other personal assets. For many accounts, a person will want these assets closed after they have passed. Unfortunately, it will not be a straightforward process for every account.&nbsp;

It is important that when you are attempting to close your loved one’s account that you are a close family member. It is much easier to get accounts closed by a close relative than an individual who has no relation to the person, unless you have been named their executor or digital executor in their Will. It is always best to have a digital copy of the deceased's death certificate or obituary to send to the company, as proof of death. Also, it is important to provide a proof of relation or of your appointed executorship to the company. Including a proof of death and your proof of relation to the deceased in your initial communication with the company will very quickly expedite your request.&nbsp;

Many companies have customer service emails, forms, or means of communication for you to reach out to them for this purpose. This may take some digging but part of handling someone’s estate is being patient. It is not an easy task and sometimes it will take time and a lot of communication before your request is granted. The shocking fact is closing an account is actually much easier than asking many companies to do anything else with an account that isn’t owned by you. Retrieving information or being able to access another person’s account is near impossible in most cases due to privacy policies and account policies that many companies have.

Again, we highly recommend creating a digital file that will allow you to not only easily update recipes but pass them on for future generations.&nbsp;

**Favourite Charities** Include all the charities and causes that have meant the most to you throughout your life, and where you’d want donations to go in your name after you pass.

**Memorialization** Let your family and friends know how to best memorialize you. Perhaps you want a tree planted in your name or your favourite park bench to include a plaque with your name on it. Write this all down and let them know what it means to you to be remembered in this way.&nbsp;

This isn’t the same as writing your own obituary. This is an informal way to share your thoughts, experiences, special stories, or anything you have in your heart and soul that you want other people to know. It shouldn’t be too long. This is a letter, not a manifesto. You can also consider recording a short video. Many people would love to hear your voice and see your face. Here are some tips for addressing everyone.&nbsp;

**Stay Focused** Address them in a brief but powerful message, about 500 words and at most a ten-minute video. Inspire people based on your experiences, offer them kind words during this difficult time, thank them for being a part of your life, or even crack a few jokes if that is who you are.&nbsp;

**Be Careful If You Want To Go Dark** Think twice about sharing something negative in this address, even if there may be some bad feelings. This is how you will be remembered and you need to consider how you want your last words to affect the people you have left behind. You’re gone so your family and friends will have to manage the backlash.

**It Doesn’t Have To Be A Story** These are your last words to the world and it doesn’t have to be a story but maybe it's a lesson you learned instead. Maybe you just want to let them know how loved you have felt over the years. There are no rules when it comes to expressing your feelings to those you care about.&nbsp;

**Tell Someone About It** While you might not want someone reading this or viewing these last words while you are alive, be sure that someone knows to look for it after you have passed. Whether it’s a handwritten letter or a digital document, leave it somewhere it can be found with instructions on where you want it posted.

Let’s talk about the elephant (or perhaps the skeletons) in the room. What do you do with the parts of your life you don’t want others to know about after you pass? Do you have secrets you want to take to your grave with you? We’re not going to judge because we all have those secrets but how do you handle those parts of your life after you’re gone? It simply comes down to identifying items and ways to eliminate them.

Some items are obvious, some aren't. The one thing you really need is a person you trust implicitly. This person will be referred to as your Cleaner, someone who will do exactly what you ask without judgement. This individual will go through your computer, dresser drawers, medicine cabinet and anywhere else questionable skeletons may lurk. Then they’ll actually delete and or destroy them without question or complaint.While a Cleaner is not an official title Executor, Health Care Proxy or Power Of Attorney, you’re trusting this person with extremely sensitive information that they will carry with them to the grave.&nbsp;

There are often four major reasons why someone may want to dispose of something - it is dangerous, illegal, embarrassing, or a secret. Whether you are trying to identify your list of skeletons or perhaps you have agreed to act as a Cleaner for someone, you will want to keep these reasons in mind.&nbsp;

**Dangerous** - Anything that poses a treat, in particular to children or teenagers, like a medicine cabinet.&nbsp;

**Illegal** \- Items or information that would have gotten you arrested if the cops searched your house while you were still alive.

**Embarrassing** - Items or information you would not feel comfortable revealing to family and friends. If it is something you wouldn’t feel comfortable bringing up during Thanksgiving in front of your family, it is something you should have disposed of.&nbsp;

**Secret** \- Information, affiliations, or relationships you wouldn’t want getting out to your family, friends, or general population.

Do not put any of this stuff in your actual Will because your Will becomes a public record. So, rather than eliminating skeletons, you’d be putting them on display. Contact your Cleaner directly and give them specific instructions for each item that should be disposed of.&nbsp;

**Computer, Phone, and Tablet**

This is probably the most obvious category and the bulk of where someone’s hidden secrets will lie. Make sure your Cleaner has passwords and access to all your devices, along with some directions if you kept things hidden especially well.

**Sweep and Clear: Browser History**

This also may seem obvious but it is often overlooked because of its obvious nature. Your browser history isn’t just adult *material*...even though that’s usually the dirty little secret. It could also be searches or other pages you visited you just don’t want people to know about.

**Sweep and Clear: Hard Drive**

Here, the Cleaner should locate and delete all offending files: Photos, videos, documents, bootleg software, and anything else you want gone. Since these files are often hidden, providing some instruction to your Cleaner would be ideal to ensure nothing goes unchecked. If photos and videos have been hidden or renamed, have the Cleaner search for file types (.jpg, .mov, etc...) or just delete the documents, photos, and video folders. The other option is tell them what to salvage, such as a photo folder, and then delete everything else.

After you do this, don’t forget to EMPTY THE TRASH or all the work was for naught. If all else fails… If you know a computer is too difficult to clean, just tell your Cleaner to either wipe it completely (factory reset) or smash it and toss it in the river.

**Sweep and Clear: External Backups**

Most people have important and possibly scandalous material backed up on an external hard drive, thumb/flash drives, DVDs or CDs. So, while a Cleaner may have already disposed of the original files, an individual may have a copy on a backup drive. There are three ways this can be handled:&nbsp;

1. Provide your Cleaner specific instructions on what needs to be done with each device.

2. Tell your Cleaner to reformat the drive and use it as new.

3. Smash it and toss it in the river along with the un-cleanable laptop.

**Sweep and Clear: Email**

Embarassing or secret emails and IMs are some of the last things you want leaked. What if you have secret email accounts no one in your immediate life knows about? From deleting everything to deleting specific communications with certain individuals, you can make that call but just leave the instructions for your Cleaner.&nbsp;

**Sweep and Clear: Phone/Tablet**

Phones and tablets will probably contain the most sensitive and embarrassing content. They are also often linked or synced to one another so, ensuring your Cleaner has access to these devices is very important. From emails to text and social media and other applications, many people will want these devices completely wiped back to factory settings to protect their lives and identity.&nbsp;

**Sweep and Clear: Apps**

The rise of a new generation of apps like Tinder, Grindr,&nbsp; and other “hook up” apps, many people may have secret communications or embarrassing connections on these applications. These applications may “out” an individual and reveal part of their lives that they may not have wanted their friends and family to know about. Deleting these applications or completely resetting devices is an essential role of a Cleaner.&nbsp;

**Deactivate: Site Memberships and Digital Subscriptions**

We have already discussed applications that people may have in secret but what about website membership and subscriptions? Throughout someone’s life, a person will accumulate a variety of subscriptions. Some may be innocent like streaming services and others may be considered more “adult content” or unsavoury. 1\. List Of All Your Digital Assets And How To Access Each One

Gather every online account you own including, online banking accounts, social media accounts, accounts for your utilities, credit card accounts, any accounts you make payments on or loan accounts, and just about any online account you can think of. This will ensure there is no stone left unturned when your estate is being settled by your executor and it will make settling your estate much easier. This also includes listing all the hardware you own and how to access them, such as, computers, tablets, phones, e-readers, cameras, and other digital devices. Other accounts you don’t want to forget about are digital clouds, email, gaming accounts, websites, domains, blogs, and intellectual properties.&nbsp;

2\. Decide What You Want Done With These Assets

With so many accounts and pieces of hardware to inventory, a spreadsheet may be your best option for staying organized. When you decide how you want each of the accounts settled, you can leave detailed instructions for accessing the account and the actions that need to occur to settle the account. You may need to conduct some research on if and how you can pass on certain accounts or assets to your executors. Additionally, you may need to do some research on how an executor would be able to close your account, as all companies have their own terms of service.&nbsp;

If your assets have some sort of value to them, you will want to make note of that and ensure your executor will be able to redeem the valuable assets or inherit them. If assets will continue to generate revenue, it's worth thinking about where that money is going, and who will be able to access it after you're gone. In most states, a Digital Executor is not a legally binding or enforceable designation at the moment. Even so, you should still name a Digital Executor, as this person can be designated by your Executor to follow the wishes laid out in your digital estate plan, or can at least help your Executor with the digital aspects of your estate.

4\. Store This Information In A Secure But, Accessible Location

There are three main ways you can securely store this kind of sensitive information.

Regardless of how you want to store this information, you should inform your digital executor and other important people in your life about where they can go to access this information. It is only in 2012 that Uniform Law Commission began considering the legality of passing on one’s digital legacy. Previously, very few laws helped to determine who could access these files and accounts if the account owner became incapacitated or died. If the deceased or incapacitated person wanted any of their digital assets to be deleted, modified, or distributed to loved ones, there was no way to discern who would have a legal right to access them. Additionally, unless the person provided usernames and passwords, the fiduciary would have no ability to access them. Due to the vague and confusing nature of the situation, digital assets would often be deleted by the company that controls them, or they would just continue to linger on the Internet or on devices long after the person's death, deemed untouchable by family and friends.

Initially, the Uniform Fiduciary Access to Digital Access Act (UFADAA) treated digital assets like traditional property. This meant owners could decide what would happen to them and the fiduciaries could have control of them when the owner died or became incapacitated. Under this initial law, an appointed executor would have the same right to access the deceased person's accounts as the deceased person had during life. If the executor did not have or needed login or password information, he or she could ask the company for access and the company would have to comply.

The issues that were raised during the initial stages of this law were

* It invaded the deceased person's privacy in ways that they would not have imagined or wanted

* It raise liability concerns for the companies who promised to keep the accounts secure

* It infringed on the privacy of third parties whose communications or information might be exposed to the executor

* It miscategorized digital property, which is substantially different than traditional assets in the hands of an executor

* It created conflicts with the privacy provisions in federal law.

Invading personal privacy was a huge issue with this initial law and the reason why many privacy advocacy groups spoke out against the law. While many people believe that your life on the internet is public and an open book. However, many people also participate in parts of the internet they may be embarrassed by or there may be information they want to keep a secret from their family and friends. The initial law gave too much free reign to fiduciaries and conflicted with privacy rights of the deceased. Additionally, technology companies were forced to violate privacy laws while complying with UFADAA. Also, this overrides the Terms of Service agreements that companies have that make digital assets non-transferable and put strong restrictions on who can access accounts.

The revised version of the law greatly reduces the executor’s authority and access. The major changes to the law are briefed below:

* An executor no longer has authority over the content of electronic communications (private email, tweets, chats), unless the deceased person explicitly consented to disclosure.

* An executor can be allowed access to other types of digital assets; however, the executor must petition the court and explain why the asset is needed to wrap up the estate.

* If a fiduciary does not have explicit permission through a will, trust, or power of attorney, executors can look to the terms of service agreements to determine whether to comply with requests for access to a deceased person's account.

* Executors may: Request court orders; Limit their compliance by providing access only to assets that are "reasonably necessary" for wrapping up the estate; Charge fees to comply with requests for access; Refuse unduly burdensome requests.

* Executors may not provide access to deleted assets or joint accounts.

This new revised law will be enacted by most states but it is up to you, the individual, to ensure and determine how you want your personal digital assets managed.
